Overview
New York State law authorizes mobile sports wagering when a sports wager is made through virtual or electronic means from a location within New York and is transmitted to and accepted by electronic equipment located at a licensed commercial casino gaming facility. The Commission controls the wagering menu offered by licensed operators and limits sports and leagues accepted for sports wagering.
Proposition Wagers
Wagers on an individual player or specific event in a game/match that are not directly connected to the game’s outcome are called proposition wagers (aka prop bets). These wagers allow bettors to bet on outcomes within the game.
How does the Commission determine which proposition wagers are allowed?
Generally, wagers based on an official statistic of the sport with no negative implication are acceptable.
Examples:
“Will Player X will score at least Y points in the first quarter?”
“Will Quarterback X will make Y completions in the game?”
Wagers that include a negative implication that can be controlled by a single player require further scrutiny by the Commission and may be rejected.
Examples:
“Will Hitter X will strike out in the first inning?”
“Will Player X will foul out in the first quarter?”

Taxes & Revenue
Sports wagering revenue is taxed at 51 percent with all funds providing aid to education to New York’s public schools, except:
- $5 million annually to fund sports programs for underserved youths (administered by the NYS Office of Children and Family Services)
- $6 million annually to fund problem gambling education and treatment (administered by the NYS Office of Addiction Services and Supports).

Prohibited Events
Wagers cannot be placed on any sport or athletic event in which any New York college team participates, regardless of where the event takes place, or high school sport or athletic event.
